Employers can mandate COVID-19 vaccination for on-site workers, says the U.S. Equal Employment Opportunity Commission (EEOC). The agency, which released updated guidance on May 28, additionally noted that employers can offer vaccine incentives so long as the incentives are not "coercive." However, an employee's vaccination status must be kept confidential, and employers must comply with Title VII and the Americans with Disabilities Act in accommodating workers who can't get vaccinated because of a disability, religious beliefs, or pregnancy. The EEOC also addressed vaccine equity in its guidance, stating: "Employers should keep in mind that because some individuals or demographic groups may face greater barriers to receiving a COVID-19 vaccination than others, some employees may be more likely to be negatively impacted by a vaccination requirement."
